Welcome to My Buddy Abroad! My Buddy Abroad is an online platform for travellers to connect with locals (called buddies) online and book a service directly with the buddy.
1. Introduction to our site
1.1 Welcome to the Mybuddyabroad platform (the 'Site'). We'll refer to our website and other services as our "Services", and Mybuddyabroad will be addressed individually or collectively as "Mybuddyabroad", "we", "us", or "our". Do read through the following Terms of Service carefully before using the Site or any of our Services. By browsing our Site, you'll be agreeing to our Terms. The Terms are here for you, so that you are aware of your legal rights when using our services.
1.2 This document and any documents referred to within it will collectively make up the 'Terms of Service'.
1.3 Our "Services" include (a) the site, (b) the services provided by the site, (c) all information, linked pages, features, data, text, images, photographs, graphics, music, sounds, video, messages, tags, content, programming, software, social media accounts, application services. Any new features added to or augmenting the Services are also subject to these Terms of Service. Content that is posted by Users using our Services will be "Your Content". Your Content includes your usernames, profile pictures, photos, descriptions, reviews, comments, videos etc.
1.4 Our services include an online platform service that provides a place and opportunity for the sale of goods or services between the buyer ("Buyer" or "Tour Guest" or "Traveller") and the seller ("Seller" or "Buddy"), collectively known as "Users" or "Parties". The actual contract for a sale is directly between the Buyer and the Seller. We are not a party to that contract or any other contract between Buyer and Seller. Parties to the transaction will be entirely responsible for the sales contract between them in accordance to the listing of goods, warranty of purchase and like. As such, We accept no obligations in connection to these contracts. However, if you have problems with your order, we may step in to help (refer to section 10). We do not pre-screen travellers and cannot ensure that Users will actually complete a transaction.
1.5 We reserve the right to change, modify, suspend or discontinue all or any part of this Site or Services at any time. We may release certain Services or their features while they are still considered to be a beta version, which may not work correctly or in the same way as how the final version may work, and cannot be held liable in such instances. We may also impose limit on certain features or restrict your access to parts of, or the entire Site or Service at its sole discretion without notice or liability.
1.6 We reserve the right to refuse to provide you access to the Site or Service or to allow you to open an Account for any reason.
2.2 Users in possession of another User's personal data obtained through the use of the Services hereby agree that, they will (a) comply with all applicable personal data protection laws, (b) allow Users (owners of personal data) the right to remove their collected data from User (receivers of personal data) from the database upon request.
3. Your Account
3.1 You might need to create an account with Us to use some of our Services. Here are a few rules about accounts with Us:
3.1.1 You must be 18 or older to use our Service. Otherwise you may only use our Services under the supervision of a parent or legal guardian.
3.1.2 Be honest with us, and provide accurate information about yourself. It's not OK to use false information or impersonate another person or company through your account.
3.1.3 You are responsible for your account. You're solely responsible for any activity on your account. If you're sharing an account with other people, then the person's name on the account will be ultimately be responsible for all activity. If you're registering as a business entity, you personally guarantee that you have the authority to agree to the Terms on behalf of the business. Also, your accounts are not transferable.
3.1.4 As we've mentioned above, you're solely responsible for any activity on your account, so remember to keep your login and password secure.
4. Limited License
4.1 We grant you a limited and revocable license to access and use our Services, subject to our Terms of Service. All proprietary Content, trademarks, service marks, brand names, logos and other intellectual property displayed in the Site are the property of My Buddy Abroad and where applicable, third parties proprietors identified in the Site. You agree not to copy, distribute, republish, mirror, frame or create derivative works without our prior written consent.
5. Your Content
5.1 Content that you post using our Services is your content. This includes usernames, shop names, profile pictures, listing photos, listing descriptions, reviews, comments, video, etc.
5.1.1 You are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and you're not infringing or violating any third party's rights by posting it.
5.1.2 Posting Your Content through our Services, you grant us a license to use it. This license allows us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify reproduce, distribute, store and prepare derivative works of Your Content to promote the Services or our Site. We do not claim ownership to Your Content, but we have your permission to use it to help us function and grow.
5.1.3 If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please contact us. If your Content infringes another person's intellectual property, we will remove it if we receive proper notice.
5.1.4 You agree to not post any content that is abusive, threatening, defamatory, obscene, vulgar or otherwise offensive or in violation of our Prohibited Items/Services section. You also agree not to post any content that is false, misleading or uses the Services in a manner that is fraudulent or deceptive.
6. Your Use of Our Services
6.1 We grant you a limited, non-exclusive, non-transferable and revocable license to use our Services. You agree that you will not violate any laws in connection without your use of the Services. This includes any local, state, federal and international laws that may apply to you.
6.2 You are responsible for paying all few that you owe to us. You are also solely responsible for collection and/or paying any applicable taxes for any purchases or sales you make through our Services.
6.3 You agree not to attempt to obtain source code of the services. You agree to not interfere with or disrupt/harm our services.
6.4 Violations of this policy may result in a range of actions, including any or all of the following: listing deletion, account suspension or legal action; if necessary.
6.5 If you believe a User on our Site is violating these terms, please contact us.
7. Purchase and Payment
7.1 Currently we only support Credit Card payments. These payments are processed through third-party payment channels may vary depending on the jurisdiction you are in.
7.2 All sales on the platform are biding. The seller is obligated to complete the transaction with the buyer in a prompt manner unless an exceptional circumstance arises.
8. Seller Commission
8.1 The seller of any item/service will pay us a commission on the total transaction amount received by the seller (including taxes, if any and shipping costs for any of the transactions made on our Site.
8.2 Our commission will be deducted directly from your funds before the funds are settled into your account.
8.3 All third-party payment channels will charge you an additional fee for payment processing. This fee will be dependent on your location as well as your buyer's location. All payment processing fees will not be included in seller commission that we charge.
9. Seller's Responsibilities
9.1 Sellers will properly manage and ensure that relevant information such as the price and the details of activities and will not post inaccurate or misleading information.
9.2 Sellers are obligated to deliver items/services as described in a prompt manner, unless there is an exceptional circumstance. If there are any exceptional circumstance the seller is obliged to contact the Buyer to inform them of any delays or inability to complete the transaction.
9.3 Sellers will issue additional receipts, credit card slips or tax invoices to Buyer on request.
10. Disputes with Other Users
10.1 If you find yourself in a dispute with another user of our Services or a third party, we encourage you to contact the other party and try to resolve the dispute amicably.
10.2 Should you be unable to resolve the dispute between you and another user, we may step in to help resolve the dispute. If you would like us to get involved, please contact us. We will help in good faith based on our policies. However, we will not make judgments regarding legal issues or claims.
10.3 Whether you are a Buyer or a Seller of an item/service, you must cooperate with us throughout the dispute resolution process. We ask that you provide all information relating to the dispute that we request for. Such requests will be directed to your designated email address. If we are unable to get a response from you we may close the investigation or determine that the investigation has been resolved in favour of the other party.
10.4 Issues or Complaints
We'll assist you in case of issues or complaints where possible.
In case of a complaint about, or issue with the platform, app or services, please contact My Buddy Abroad at firstname.lastname@example.org to within 1 day after the issue occurred. You agree to cooperate with and assist My Buddy Abroad in good faith, provide relevant information and take such actions as may be reasonably requested by My Buddy Abroad.
10.5 As a Buddy you agree that in case of a no show or dissatisfactory deviations in the event caused by you, the guest will be refunded and you won't receive payment. As a guest you understand that in case of a no show or no completion of/interruptions during the event caused by you, you as a guest are responsible for any damages up to the amount paid.
10.6 In case of any damage claims or other complaints related to the event exceeding the amount paid, My Buddy Abroad will mediate in finding a reasonable solution between the tour guest and Buddy.
11. Disputes with Us
11.1 If you are upset with us, please let us know and hopefully we can resolve your issue. Any issues raised against My Buddy Abroad in respect of the service must be promptly summited within 14 days after the reserved event has taken place. Any claim or complaint that is summited after the 14 days period, may be rejected and the claimant shall forfeit its right to any (damage or cost) compensation.
If we are unable to resolve the issue, these rules will govern any legal dispute involving our Services:
11.1.1 Governing Law. The My Buddy Abroad's local laws govern the Terms of Service. The local laws are dependent on the location of incorporation – Scotland . These laws will then apply no matter where in the world you live.
11.1.2 You agree that any dispute or claim arising from the Terms will be settled by arbitration where possible. Judgment on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under the Terms will take place on an individual basis: class arbitrations and class actions are not permitted. Any decisions made by the arbitrator will be deemed final.
12. Changes to the Terms
12.1 We are constantly updating and improving the Service to try and find ways to provide you with new and innovative features and services. Improvements and updates are also made to reflect changing technologies, tastes, behaviours and the way people use the Internet and our Service.
12.2 We may revise the Terms of Service but the most current version will always be at this link.
12.3 We will try, where possible and reasonable, to contact you to let you know about significant changes to any of the documents referred to in these Terms of Service. We may make contact through the system or via a separate email.
12.4 The current version of the Terms of Service contains the only terms that apply to our relationship with you. Older versions of the Terms of Service will no longer apply to our relationship and will be completely replaced by the current version.
13. Prohibited Items/ Services
My Buddy Abroad is not a curated marketplace. However, for a variety of reasons we prohibit certain types of items from our marketplace. Some of these items present legal risks to our community.
It is the Seller's responsibility to ensure that their proposed item complies with all laws and is allowed to be listed for sale in accordance to local laws' of the marketplace's incorporation. For Seller's convenience we have provided a non-exhaustive guideline on prohibited and restricted items that are not allowed for sale. We will update this guideline from time to time where necessary.
If an item/service is found to be in violation of this policy, we may subject the Seller to a range of adverse actions, including listing deletion, account suspension, account termination and legal action
The following types of items are prohibited:
ii. Tobacco products, smokeable products, e-cigarettes and e-liquid
iii. Drugs and drug paraphernalia
iv. Medicine, medicinal instruments and items with objectionable medical claims. Listings are prohibited to make claims such as having a causal relationship between a substance and the prevention, cure or treatment of a disease or condition.
v. Live animals and insects
vi. Items made or derived from animals, including, but not limited to, endangered species and exotic animals
vii. Ivory or bones, including tusks, elk ivory, fossilized ivory and wooly mammoth ivory from ivory-producing animals.
viii. Human beings, human remains, body parts and items made from human remains, except for hair
ix. Hazardous materials which are flammable, explosive, corrosive, radioactive material, poisonous or otherwise dangerous
x. Items or listings that promote, support or seek to engage users in illegal activity
xi. Items or listings that promote, support or glorify hatred and seek to discriminate and/or demean on the basis of race, religion, gender, gender identity, disability or sexual orientation
xii. Items that infringe copyright laws including, but not limited to, unauthorized sales of eBooks
xiii. Counterfeit items
xiv. Unauthorized resale of tickets
xv. Stolen or Illegal goods
xvi. Illegal services not limited to prostitution
xvii. Pornography and adult material and services including, but not limited to, pornographic books, magazines, videos and pictures
xviii. Used undergarments and intimate items
xix. Recalled items or items that present unreasonable risk of harm
xx. Mislabeled goods
And any other items illegal or restricted in the jurisdiction of the Buyer and/or the Seller or which otherwise encourage illegal or restricted activities.

14. General Booking Information
14.1 It is the Buyers responsibility to review the description of any service you intend to book, to ensure that you (and any Additional Guests you are booking for) meet any minimum age, proficiency, fitness or other requirements which the buddy may specify in the Listing. It is your responsibility to advise the Buddy of any matters or circumstances which may impact you, or any of the Additional Guest’s ability to safely participate in the Buddy’s service, which include, but is not limited to medical or physical conditions.
14.2 Buyers and tour guests are responsible for identifying, understanding, and complying with all laws, rules and regulations that apply to the buyer and/or Additional Guest’s in respect of your/their involvement in any Buddy’s service.
14.3 You and any Additional guests are required to adhere to the Buddy’s instructions.
14.4 You are only allowed to bring Additional Guests if such Additional Guests were added by you during the booking process on the My Buddy Abroad Website.
15.1 The Buddy’s personal profile and Listings are available on the My Buddy Abroad Website and buyers wishing to book Buddy Services will select a particular Listing and will be prompted to provide their first name, surname, confirm the date and time they wish to book a Listing, email address, phone number and subject to acceptance of a Booking Request, be granted access to the My Buddy Abroad’s messaging platform via the Booking Management System.
15.2 The Booking Management System shall forward the Buyer’s request in respect of a Listing to the Guide by email as a Booking Request.
15.3 Upon acceptance of a Booking Request you are entering into a legally binding agreement with the Buddy and the Buddy is obliged to provide the Service(s) to you as described.
15.4 My Buddy Abroad shall have access to and will be able to view all communications between the Booking Management System, payment management system and any communication between Tour Guests and Guides via the communication management system.
16. Booking Modifications, Cancellations and Refunds
16.1 Buyers and Sellers are solely responsible for any Booking Modifications and where applicable the buyer agrees to pay any additional Service Fee and/or any applicable Taxes associated with such Booking Modifications.
16.2 In the event that a buyer wishes to cancel an Accepted Booking then:-
16.2.1 their right to do so (and any refund of the Listing fee) is subject to any cancellation policy of the Guide or in respect of the Listing;
16.2.2 subject to clause 16.2.1, the buyer must give written notice of cancellation (“Cancellation Notice”) to MY BUDDY ABROAD to be received before the Guide Service is due to commence (“Commencement Time”);
16.2.3 subject to clause 16.2.1, if a Cancellation Notice is received more than 2 weeks before the Commencement date, then MY BUDDY ABROAD shall refund the Listing fee in full, less any administration charge of MY BUDDY ABROAD for making such refund (“Admin Charges”), and such refund shall be made within 30 days;
16.2.4 subject to clause 16.2.1, if a Cancellation Notice is received two weeks or less before the Commencement date, then there shall be no refund.
16.2.5 if the buyer has booked any other goods or services to be provided by 3rd parties which cannot be cancelled (or some cost is levied for such cancellation)(for example, entrance tickets or reservations) then, irrespective of when the Cancellation Notice is received, MY BUDDY ABROAD shall also be entitled to deduct the cost of these goods or services from any refund;
16.2.6 in the unfortunate event that a buyer needs to cancel an Accepted Booking due to illness, family bereavement or some other exceptional circumstance, then the buyer should provide MY BUDDY ABROAD with all relevant details when sending the Cancellation Notice; Provided that it shall then be in the discretion of MY BUDDY ABROAD as to whether it makes any ex gratia refund and, if so, of what amount of the Listing fee.
16.3 In the event a Buddy cancels an Accepted Booking, the buddy will receive a full refund of the Listing fee for such booking and the Guide will be liable for the Service Fee. Buddies shall be entitled to cancel an Accepted Booking where they can demonstrate a valid reason for such cancellation, which may include concerns regarding a Tour Guest’s conduct or behaviour, in which case the Tour Guest will not be entitled to a refund.
16.4 buddies may cancel an accepted booking where, due to unforeseen circumstances, such as weather, providing the Guide Service would be hazardous to both Guides and/or Tour Guests. Guides shall be entitled to modify or cancel a Guide Service in such circumstances and My Buddy Abroad will work with the Guide to provide Tour Guests a full refund or rebook the Guide Service.
16.5 My Buddy Abroad may in its sole discretion decide that it is necessary to cancel an Accepted Booking and take certain actions to refund buyers where My Buddy Abroad believes in good faith, that such action is required in order to avoid significant harm to either My Buddy Abroad, buyers, buddies, other third parties or property.
17. Ratings and Reviews
17.1 Buyers can leave a Review and submit a Rating in respect of the Service. Any Ratings or Reviews left by a Buyer must be truthful and accurate and must not be misleading in any way.
6.2 Users are prohibited from manipulating the Reviews and Ratings system in any manner.
17.2 You acknowledge that My Buddy Abroad has the right to monitor your access or use of the Platform. Although there is no obligation on My Buddy Abroad to monitor how the platform is used it may do so to ensure that all users: (i) comply with these Terms; (ii) Comply with applicable law; (iii) comply with order or requirement of a court, law enforcement agency or other governmental administrative agency (iv) remove harmful content or material; or (v) improve the Platform. Buddies and Buyers will assist My Buddy Abroad and provide My Buddy Abroad with any information reasonably requested by My Buddy Abroad and take any reasonable action required to assist in any investigation that may be undertaken in respect of a Buddy or Buyer using the Platform.
18.1 My Buddy Abroad may immediately, without notice terminate this Agreement if (i) you have materially breached your obligations under these User Terms (ii) you have violated applicable laws, regulations or third party rights, or (iii) My Buddy Abroad believes in good faith that such action is reasonably necessary to protect the personal safety or property of My Buddy Abroad, its Buddies, other Users, Tour Guests or third parties.
18.2 On termination of this Agreement, My Buddy Abroad will be entitled to retain the Service Fee. The Buddy will be entitled to retain any sums due to him/her pursuant to the cancellation policy in respect of an Accepted Booking (the “Buddy Cancellation Fee”). My Buddy Abroad shall deduct the Service Fee and the Buddy Cancellation Fee from the Listing Fee and remit the difference to the Buyer within 30 days of termination of this Agreement by My Buddy Abroad.
19. Liability and Indemnity
19.1 To the fullest extent permissible by law, My Buddy Abroad accepts no liability to Users, Tour Guests or Buddies for loss or damage that is not foreseeable.
19.2 To the fullest extent permissible by law, My Buddy Abroad excludes all representations, warranties, and guarantees (whether express or implied) that may apply to the Platform or any My Buddy Abroad Content or Guide Content on the Platform.
19.3 My Buddy Abroad accepts no liability for loss of profits, sales, business or revenue; loss of business opportunity, goodwill or reputation; loss of anticipated savings; business interruption; or for any indirect or consequential loss or damage.
19.4 My Buddy Abroad exercises all reasonable skill and care to ensure that the Platform is free from viruses and other malware. My Buddy Abroad accepts no liability for any loss or damage from a virus or other malware, a distributed denial of service attack, or other harmful material that may adversely affect your hardware, software, data or other material that occurs as a result of your use of the Platform (including the downloading of any My Buddy Abroad Content or Guide Content or any other website or service that My Buddy Abroad may provide a link to.
19.5 My Buddy Abroad neither assumes nor accepts responsibility or liability arising out of any disruption or non-availability of the Platform resulting from external causes including, but not limited to, Internet Service Provider equipment failure, host equipment failure, communications network failure, natural events, acts of war, or legal restrictions and censorship.
19.6 Nothing in these User Terms excludes or restricts My Buddy Abroad’s liability in any situation where it would be unlawful for us to do so including fraud or fraudulent misrepresentation, for death or personal injury resulting from negligence, or for any other forms of liability which cannot be excluded or restricted by law.
19.7 The Buddy and Buyer agree to release, defend (at My Buddy Abroad’s request), indemnify, and hold My Buddy Abroad and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your breach of these User Terms or our Acceptable Use Policy or Website Terms and Conditions, (ii) your improper use of the Platform or any My Buddy Abroad Services, (iii) your interaction with any Guide, Buddy or another Tour Guest, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, or (iv) your breach of any laws or regulations.
20. Applicable Law and Jurisdiction
20.1 These User Terms and the relationship between the Buddies, Buyers and My Buddy Abroad (whether contractual or otherwise) shall be governed by, and construed in accordance with, Scottish Law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. Judicial proceedings that you are able to bring against us arising from or in connection with these User Terms may only be brought in a court located in Scotland and you agree to submit to the exclusive jurisdiction of the Scottish courts.
20.2 Any disputes concerning these User Terms, the relationship between Buddies, Buyers and My Buddy Abroad, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of Scotland.
21. General Provisions
21.1 My Buddy Abroad may transfer (assign) its obligations and rights under these User Terms to a third party (this may happen, for example, if My Buddy Abroad sells the business). Your rights under these User Terms will not be affected and My Buddy Abroad’s obligations under these User Terms will be transferred to the third party who will remain bound by them.
21.2 You may not transfer (assign) your obligations and rights under these User Terms.
21.3 If any of the provisions of these User Terms are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that / those provision(s) shall be deemed modified to the minimum extent necessary to make it valid and enforceable.
21.4 No failure or delay by My Buddy Abroad in exercising any of My Buddy Abroad’s rights under these User Terms means that My Buddy Abroad have waived that right, and no waiver by My Buddy Abroad of a breach of any provision of these User Terms means that My Buddy Abroad will waive any subsequent breach of the same or any other provision.
21.5 No joint venture, partnership, employment, or agency relationship exists between you and My Buddy Abroad as a result of this Agreement or your use of the Platform.
We do our very best to make sure all the information we provide you is 100% correct. However, as we are human beings too, errors are made.
We hereby disclaim all warranties and conditions with regard to the use of our website and/or services, including, but not limited to, the availability, reliability, or quality of our website and services, the events distributed through us, including the nature and quality of the events, and is not and shall not be responsible for any error, fault or mistake of any and all content and information received through our us, including by buddies or travelers. We do not endorse any entity, product or service mentioned in any user generated content available on our website.
If you choose to use the My Buddy Abroad Website to book a service, you do so voluntarily and at your sole risk. The My Buddy Abroad Website is provided “as is”, without warranty of any kind, either express or implied.
You agree that by booking a listing you are contracting directly with the Buddy and My Buddy Abroad is not and does not act as agent, in any capacity whatsoever and is not and does not become a party in any contractual relationship between Buddy and buyer is not entering into an agreement with you.
You agree that you have had whatever opportunity you deem necessary to investigate the My Buddy Abroad Website, Guides Services, laws, rules, or regulations that may be applicable to the Listing you wish to book and that you are not relying upon any statement of law or fact made by My Buddy Abroad in relation to booking a Listing.
By booking a service, you acknowledge and accept these User Terms. My Buddy Abroad reserves the right to modify these User Terms at any time.

2. Information collected or received.
2.1 To use our platform to transact, you will need to provide us with a valid email address. Depending on the services you choose, we may collect additional information, for example: If you are a seller, we will collect additional information such as payment information, contact number and an address. Please note that for security and performance reasons, such content may need to be accessed by internal personnel from time to time.
2.2 Your username is publicly displayed. Other people may see the date you joined; ratings, reviews and related photos for items you are selling or have sold; your profile information; items you listed for sale; your shop pages.
2.3 We use technologies such as cookies, clear gifs, log files and flash cookies for several purposes, including to help understand how you interact with our site and services, in order to provide a better experience. The information we collect may include, without limitation, your Internet Protocol (IP) address, computer/mobile device operating system and browser type, type of mobile device, the characteristics of the mobile device, the address of a referring web site (if any), and the pages you visit on our website and mobile applications and the times of visit.
2.4 We automatically receive and record information (for example: an email address or IP address, cookies, and data) about a person who is not yet registered in connection with certain features.
2.5 We may contact individual shop owners to confidentially request more information about their shops or items listed on the Site, or to ensure compliance with our rules and applicable law.
2.6 When you connect to us or register an account using external third-party applications or services, such as Facebook, using an application programming interface (API), you will be granting us permission to receive information from these third-party applications. You can also choose to share some of your activity to certain social media networks which are connected to your account.
3. Uses and Sharing
3.2 We generally use the information to provide and improve our services and products, for billing and payments, for identification and authentication, for targeted online and offline marketing, to contact members or interested parties, and for general research and aggregate reporting. For example, we could use your feedback to improve our services; we use data analytics and work with certain third-party service providers for targeted online and offline marketing; and of course, we use your email address to communicate with you. We also partner with service providers and other third parties that collect, use, promote, and analyse information about our marketplace.
